WHAT DOES THE "RIGHT OF WITHDRAWAL" CONSIST OF?

Purchases made on 158 Studio Srl are subject to the provisions of Legislative Decree 2016/2005 (Consumer Code), regarding distance contracts, in cases where the delivery of the goods takes place at the domicile or different place indicated by the buyer or in cases of purchases made outside the commercial premises.
The importance of the aforementioned legislation is embodied in the provision for the buyer of the "Right of withdrawal".
In terms of law, the consumer can exercise the right to withdraw from the contract within 14 days of receiving the goods, returning the goods subject to the withdrawal to the seller, who will be required to reimburse the price of the returned goods. It is specified that in the case of prize operations (the so-called promotions), in which the purchase of a good is combined with another good that is sold at a negligible price or even given as a gift, the right of withdrawal will be legitimately exercised with the return of both goods object of the purchase, given the constraint of the accessory nature of the promoted good compared to the first.

CAN YOU EXERCISE THE “RIGHT OF WITHDRAWAL”?

The legislation provides that the right of withdrawal can only be exercised by natural persons (consumers) acting for purposes that can be considered unrelated to their commercial activity. The right of withdrawal, therefore, cannot be exercised by legal entities and natural persons acting for purposes related to a commercial activity. Purchases made by resellers or by individuals who in any capacity purchase for resale to third parties are also excluded from the right of withdrawal.

WHAT DOES THE "RIGHT OF WITHDRAWAL" EXCLUDE?

The "Right of withdrawal" excludes all purchases whose delivery is completed within a point of sale.
The right of withdrawal applies to goods purchased and therefore excludes delivery costs to the recipient which constitute a service that the latter has used.

HOW IS THE "RIGHT OF WITHDRAWAL" EXERCISED?

To exercise the "Right of withdrawal", you must have the following available: the original invoice or the order number

A communication must be sent to 158 Studio Srl at the address nicolettapassarelli@158studio.com , containing the declaration of wanting to exercise the "Right of withdrawal", indicating all the above data, i.e. your order number, the invoice number, the e-mail address and which products must be subject to withdrawal by identifying them with the item code, as well as the bank details that will allow a 158 S tudio S rl to make the bank transfer to you for the refund. If the payment for the goods was made online through the PayPal or GestPay circuits, the refund will be made through the same payment circuit used.

HOW IS THE RETURN SHIPPING DONE

After activating the withdrawal procedure and receiving authorization from Customer Service, it is necessary to insert the products in their original packaging and place everything in special packaging, in such a way as to safeguard the original packaging of the products from any damage, written or alteration. 158 S tudio S rl reserves the right to refuse the goods received in the event of failure to comply with the above procedure.

HOW LONG IS THE REFUND GIVEN FOR RETURN?

The refund for the return is made as soon as the integrity of the returned goods is verified and in any case within 14 days of receipt of the same. 158 S tudio S rl will credit the Customer with the amount corresponding to the value of the goods resulting from the order confirmation. In the aforementioned credit, the price paid for the purchase net of initial shipping costs.

WARNINGS

158 S tudio S rl reserves the right from now on not to accept shipments of products that:

- do not contain original packaging, accessories or manuals
- were carried out without activating the request for intervention from the Assistance Office 158 S tudio S rl and received the necessary authorization
- have been carried out without following the sending methods indicated by the Assistance Office 158 S tudio S rl
In such cases the goods will be returned to the customer and the related transport costs will be borne by the customer.
